Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the website, platform, account features, products, and services provided by Axiom Advanced Computing Inc., operating as Axiom GPU ("Axiom GPU," "we," "us," or "our"). By creating an account, accessing the platform, activating a package, submitting a transaction, or otherwise using Axiom GPU services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform.
2. Eligibility
You must be at least 18 years old, or the minimum legal age required in your jurisdiction, and legally capable of entering into a binding agreement to use Axiom GPU. You are responsible for determining whether your use of the platform and its services is permitted under the laws and regulations applicable to you.
We may restrict access to the platform in jurisdictions where providing or using particular services would violate applicable law, regulatory requirements, sanctions, or internal compliance standards.
3. User Accounts
Certain Axiom GPU services require you to create and maintain a user account. You agree to provide accurate and current information, maintain the confidentiality of your login credentials, keep your registered email account secure, and promptly notify us if you suspect unauthorized access to your account.
You are responsible for activities conducted through your account, subject to applicable law. Accounts may not be sold, transferred, rented, shared, or otherwise provided to another person without authorization from Axiom GPU. We may request additional information or verification where reasonably necessary for security, withdrawals, fraud prevention, compliance, or account recovery.
4. Axiom GPU Services
Axiom GPU provides technology-related services associated with GPU and computing infrastructure and may make compute packages, account features, rewards, promotions, referral programs, and related services available through the platform.
The specific characteristics of each package or service, including its activation amount, duration, compute class, purchase limits, reward structure, payout schedule, capital-return conditions, and other applicable terms, are those displayed on the platform at the time of activation unless otherwise stated.
5. Package Purchases and Activations
Before activating any package, you are responsible for reviewing the terms and information displayed for that package. Package information may include the activation amount, compute class, operating period, reward or payout schedule, total projected or specified payout, purchase limits, capital-return conditions where applicable, and other package-specific restrictions.
A package becomes active only after the applicable transaction has been successfully recorded and confirmed by the platform. Users are responsible for verifying all transaction details before completing a purchase or activation.
6. Rewards, Earnings and Account Balances
Where Axiom GPU provides rewards, earnings, credits, bonuses, or other account benefits, eligibility and calculation are governed by the applicable package or program rules displayed on the platform. Account balances shown within the platform constitute platform records and may be subject to transaction verification, security review, compliance review, and correction of technical errors.
Axiom GPU may correct account balances or transaction records resulting from duplicate credits, technical errors, unauthorized activity, fraud, system malfunction, incorrect calculations, or abuse of platform features.
7. No Guarantee of Future Results
Past performance, previous rewards, promotional examples, projections, simulations, historical platform results, or package examples do not necessarily guarantee future results. Technology operations, digital assets, computing demand, network conditions, operating expenses, third-party providers, regulation, and other factors may involve uncertainty and risk.
Users are responsible for independently evaluating whether use of any Axiom GPU service or package is appropriate for their personal circumstances and risk tolerance.
8. Deposits
Deposits must be made using payment methods, assets, addresses, and blockchain networks supported by the platform. Users are responsible for selecting the correct payment network, sending supported assets, using the correct deposit address, paying applicable blockchain or third-party fees, and confirming all transaction information before submitting payment.
Transactions sent using an unsupported network, asset, address, or payment method may be delayed or permanently lost. Axiom GPU is not responsible for losses caused by incorrectly entered transaction details or transactions sent outside the payment instructions provided by the platform, except where required by applicable law.
9. Withdrawals
Withdrawals may be subject to minimum withdrawal amounts, applicable fees, security verification, account verification, fraud-prevention reviews, compliance reviews, blockchain confirmation times, processing requirements, and service availability.
Users are responsible for confirming that the withdrawal address, asset, and blockchain network are correct before submitting a request. Cryptocurrency and blockchain transactions generally cannot be reversed after they have been transmitted to the relevant network.
10. Cryptocurrency and Blockchain Risks
Users acknowledge that cryptocurrency and blockchain transactions may involve risks including price volatility, network congestion, transaction fees, delayed confirmations, protocol failures, wallet errors, incorrect addresses, network-selection errors, cybersecurity incidents, service interruptions, and changes in law or regulation.
Axiom GPU does not control independent blockchain networks and cannot guarantee their availability, speed, cost, security, or continued operation.
11. Referral Program
Axiom GPU may provide referral or affiliate features allowing eligible users to receive rewards based on qualifying activity. Participation in any referral program is subject to the rules and eligibility requirements displayed by the platform.
Users must not make false or misleading claims, guarantee earnings or results, impersonate Axiom GPU, use deceptive advertising, distribute unlawful spam, create fraudulent accounts, manipulate referral relationships, or misrepresent Axiom GPU packages, services, risks, company information, or reward structures.
Referral rewards may be withheld, reversed, cancelled, or adjusted where activity is determined to be fraudulent, duplicated, manipulated, abusive, unauthorized, or contrary to applicable program rules.
12. Promotions and Rewards
Axiom GPU may periodically offer promotions, bonuses, daily check-in rewards, campaigns, incentives, or other benefits. These features may be subject to separate eligibility requirements, account limits, expiration periods, participation rules, and additional conditions.
Promotional features may be modified, suspended, limited, or discontinued in accordance with the applicable terms and applicable law.
13. Prohibited Activities
You may not use Axiom GPU to commit fraud or other unlawful acts, launder money, facilitate prohibited transactions, circumvent account or purchase limits, create unauthorized duplicate accounts, exploit bugs or vulnerabilities, manipulate rewards, manipulate referrals, gain unauthorized access to another person's account, interfere with platform security, distribute malicious code, conduct unauthorized automated attacks or scraping, misrepresent affiliation with Axiom GPU, or otherwise violate applicable law or regulation.
We may investigate suspected violations and take reasonable measures necessary to protect Axiom GPU, its infrastructure, users, payment systems, and service providers.
14. Account Suspension and Termination
Axiom GPU may restrict, suspend, or terminate access to an account where reasonably necessary because of suspected fraud, security concerns, violation of these Terms, abuse of platform features, unauthorized activity, attempts to manipulate or exploit the platform, or legal and regulatory requirements.
Where appropriate and legally permissible, we may request additional verification or provide an opportunity to resolve an account issue before permanent account closure. Termination does not eliminate rights or obligations that arose before termination.
15. Fees
Certain transactions or services may involve fees, including blockchain network charges, payment-processing fees, withdrawal fees, or other service charges. Platform-controlled fees will be disclosed where applicable. Blockchain and third-party fees may change independently of Axiom GPU and may vary based on network or provider conditions.
16. Taxes
You are responsible for determining and satisfying any tax obligations arising from your use of Axiom GPU, including obligations associated with rewards, earnings, digital assets, transactions, referrals, or withdrawals. Axiom GPU does not provide individualized tax, legal, or accounting advice.
17. Platform Availability
We seek to provide reliable access to Axiom GPU, but uninterrupted or continuous availability cannot be guaranteed. Services may temporarily become unavailable due to maintenance, upgrades, security incidents, network failures, blockchain conditions, third-party service interruptions, infrastructure problems, or circumstances beyond our reasonable control.
18. Intellectual Property
The Axiom GPU name, Axiom Advanced Computing Inc. name, logos, branding, website design, graphics, software, source code, platform interfaces, text, content, and related materials are owned by or licensed to Axiom Advanced Computing Inc. and may be protected by applicable intellectual-property laws.
You may not copy, reproduce, distribute, modify, impersonate, commercially exploit, or create unauthorized derivative works from protected Axiom GPU materials without prior authorization.
19. Third-Party Services
Axiom GPU may rely on or integrate with independent third-party services, including hosting providers, blockchain networks, payment processors, communications services, analytics providers, infrastructure providers, and other technology services. Such third-party services may be governed by their own terms and privacy policies.
Axiom GPU is not responsible for independent third-party systems, services, outages, security incidents, or events outside its reasonable control, subject to applicable law.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Axiom GPU, Axiom Advanced Computing Inc., and their directors, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, inability to use, or reliance upon the platform or services.
Nothing in these Terms excludes, restricts, or limits any liability that cannot lawfully be excluded or limited under applicable law.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Axiom GPU, Axiom Advanced Computing Inc., and their directors, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, costs, and reasonable expenses arising from your unlawful use of the services, material violation of these Terms, infringement of third-party rights, fraudulent conduct, or unauthorized activity.
22. Changes to Services
We may modify, replace, limit, suspend, or discontinue platform features, packages, rewards, promotions, payment methods, referral structures, or other services as our technology, operations, commercial requirements, security needs, or legal obligations evolve. Where required by applicable law, material changes affecting existing contractual rights will be communicated appropriately.
23. Changes to These Terms
We may update these Terms periodically to reflect changes to our services, business practices, technology, security requirements, or applicable law. Updated Terms will be published on the Axiom GPU website with a revised "Last Updated" date. Where required by law, we will provide appropriate notice of material changes.
24. Governing Law
These Terms are governed by the laws applicable to Axiom Advanced Computing Inc. in Ontario, Canada, without regard to conflict-of-law principles, except where mandatory consumer protection or other applicable laws require otherwise.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.
26. Entire Agreement
These Terms, together with the Axiom GPU Privacy Policy and any additional terms expressly applicable to a specific package, promotion, referral program, feature, or service, constitute the agreement governing your use of the Axiom GPU platform.
